Are you up to date on TUPE changes?

Under the revised transfer rules coming into force tomorrow (31st January 2014), it is now easier to make staff redundant because of a workplace relocation.

Previously, any dismissal resulting from a change of work site could result in an employment tribunal claim for unfair dismissal. However the legislation no longer maintains this as the default position, meaning such redundancies can be fair.

Employers will also benefit from more leeway to change contracted terms and conditions after a transfer. They will now be able, with consent of the employees being transferred, to consult collectively on potential redundancies prior to the move.
